Taking over an existing Business

There are provisions within the legislation that allow for the continued operation of existing businesses without further approval being required. It is recommended that you request a 'file search' from Council to establish if the business you wish to operate was lawfully established and if there are any conditions that govern the operation of the business you should be aware of.

It is important to be aware that certain businesses also require registration with Council and these registrations will need to be in place before you start operating.

If you are planing to buy or establish a business involving:

  • food preparation
  • hairdressers
  • beauty or skin penetration


One issue that pops up when you are taking over or establishing a business is signage. Replacement of identification signage may be exempt under SEPP (Exempt & Complying Development Codes) 2008, however there are development standards that need to be met.

Signage is still considered to be development and signs erected without the necessary approvals may have to be removed.
